Liability Waiver

Release of Liability, Waiver of Claims, Assumption of Risks, and Indemnity Agreement

PLEASE READ CAREFULLY BEFORE SIGNING
This is a legal agreement between Flushing Family Acres (hereinafter referred to as “the Company”) and the undersigned visitor or participant (hereinafter referred to as “Participant”). By signing this waiver, the Participant acknowledges and agrees to the following:

1. 1. Acknowledgment of Risks
      The Participant understands and acknowledges that activities at Flushing Family Acres, including but not limited to outdoor activities, interaction with animals, use of recreational equipment, and participation in any events or workshops, involve inherent risks that could result in physical or emotional injury, disability, or damage to personal property.

1. 1. Assumption of Risk
      The Participant agrees to assume all risk of injury, harm, or loss arising from these activities, whether foreseen or unforeseen, and accepts full responsibility for any injury, harm, or loss resulting from their participation in activities at Flushing Family Acres.

1. 1. Release of Liability
      The Participant, on behalf of themselves, their heirs, next of kin, executors, administrators, and assigns, hereby releases and discharges Flushing Family Acres, its owners, employees, agents, and affiliates from any and all liability, claims, demands, or causes of action for any injury, damage, or loss, including but not limited to personal injury, death, or property damage, arising out of or in connection with the Participant’s visit to and activities at Flushing Family Acres.

1. 1. Indemnification
      The Participant agrees to indemnify, defend, and hold harmless Flushing Family Acres and its owners, employees, agents, and affiliates from any claims, demands, or actions brought by any third parties arising out of the Participant’s actions or inactions while on the premises.

1. 1. Medical Authorization
      In the event of an injury or medical emergency, the Participant authorizes Flushing Family Acres to seek medical treatment for the Participant at the Participant’s expense. The Participant agrees to bear all costs of such medical treatment.

1. 1. Photographic Release
      The Participant consents to allow Flushing Family Acres to use photographs, videos, or other media containing the Participant’s likeness for promotional purposes, unless explicitly stated otherwise in writing by the Participant prior to the visit.

1. 1. Governing Law
      This waiver shall be governed by and interpreted in accordance with the laws of the state of Michigan, and any disputes arising under this agreement shall be subject to the exclusive jurisdiction of the courts located in the state of Michigan.
      
      BY SIGNING THIS DOCUMENT, THE PARTICIPANT ACKNOWLEDGES THAT THEY HAVE READ, UNDERSTOOD, AND AGREED TO ALL TERMS AND CONDITIONS. THEY AGREE TO PARTICIPATE AT THEIR OWN RISK AND TO WAIVE ANY LEGAL RIGHTS TO SUE FLUSHING FAMILY ACRES FOR ANY INJURIES OR DAMAGES RESULTING FROM THEIR VISIT.
